At the end of the auction, the winning bidder’s credit card will be charged for the purchases. (There WILL NOT be a credit card fee charged to the Buyer. The credit card charge will include sales tax (8% in Springfield) and the 10% Buyer’s Premium. If you are buying $5,000 or more in merchandise and wish to pay by cash, check or certified funds at the pick-up, we will need you to contact us 24 hours prior to the closing date of the auction to work out arrangements, as we are working within the payment rules of the bankruptcy court. Please note: Buyers with Retail Tax ID numbers will need to be sure to provide us with a copy of their re-sale tax license 24 hours prior to the end of the auction. We cannot make tax adjustments at pick-up.
2. THE PICK-UP DATES & TIMES for the items on this auction are Tuesday, February 26 and Wednesday, February 27, 2013 from 9:00am to 6:00PM. All Fixtures and Shelving units may only be picked up on Wednesday, Feb. 27, 2013.
ALL ITEMS MUST BE PAID FOR AND REMOVED ON THE SCHEDULED PICK UP DATES. If the Buyer does not pay and pick up the items on the scheduled pick up dates/times, the registration credit card will be charged: the final bid plus the 10% Buyer’s Premium, plus all costs, including, but not limited to the holding/transporting/storage costs of the items.
3. PICK-UP INFORMATION: All Buyers are responsible for bringing their own packing materials and help with loading. We will not have boxes or packing materials onsite at any location. Also, for any fixtures (shelving, light fixtures, security systems, and large decorative elements….etc.) or items that require disassembly please provide your own tools and manpower.
Note that all fixtures and shelving pick up will be the 2nd day of pick up only - Wednesday, February 27, from 9am - 6pm. All items are in rented buildings and require moving out at the appropriate pick-up dates and times. We will not be able to make exceptions to this schedule.
4. DEFAULT OF BUYER: Successful bidder not paying for items by pick-up dates will be considered in default. Such default by the Successful Bidder will result in that Bidder’s liability to both the Seller and Aumann Auctions, Inc. Seller shall have the right to:
(a) declare this contractual agreement cancelled and recover full damage for its breach
(b) to elect to affirm this contractual agreement and enforce its specific performance or
(c) Seller can resell the items either publicly or privately
with Aumann Auctions, Inc. and in such an event, the Buyer shall be liable for payment of any deficiency realized from the second sale plus all costs, including, but not limited to the holding/transporting/storage costs of the items, the expenses
of both sales, legal and incidental damages of both the Seller and Aumann Auctions, Inc.
In addition, Aumann Auctions, Inc. also reserves the right to recover any damages separately from the breach of the Buyer. The purchaser agrees to pay all reasonable attorney fees and costs incurred by Aumann Auctions, Inc. in the collection of funds. The purchaser also agrees that a storage/handling fee of 2% per month be added to the balance of any unpaid balance due Aumann Auctions, Inc. and any other costs or losses incurred by the Buyer’s failure to adhere to these terms. Any debt collection or dispute proceedings will be litigated or arbitrated in Montgomery
County, Illinois at the option of both the Seller and Aumann Auctions, Inc.
Both the Successful Bidder and Seller shall indemnify Aumann Auction, Inc. for and hold harmless Aumann Auctions, Inc. from any costs, losses, liabilities, or expenses, including attorney fees resulting from Aumann Auctions, Inc. being named as a party to any legal action resulting from either Bidders or Sellers failure to fulfill any obligations and undertakings as set forth in this contractual agreement.
5. CATALOG: Aumann Auctions has put forth every effort in preparing the catalog for this auction to provide accurate descriptions of all items. All lots are sold “AS-IS, WHERE-IS”, with all faults, imperfections and errors of description. Due diligence is the responsibility of the bidder/buyer. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. Note that many of the lots are large/wholesale groups. In some photos, other items are shown in the background of the item(s) being sold or additional items can be seen on nearby shelves. We have added verbiage to the description in an attempt to adequately describe the item(s) being sold. Please read description in addition to viewing the photos.
